Switzerland Privacy Addendum (FADP)

This addendum supplements the eGifter Global Privacy Policy and applies to residents of Switzerland. It is provided in accordance with the Swiss Federal Act on Data Protection ("FADP"), as revised and in force from September 1, 2023.

This addendum should be read together with the eGifter Global Privacy Policy, which describes our general data practices, categories of personal information, and sources of data.

1. Data Controller

GroupGifting.com, Inc. d/b/a eGifter, 315 Main Street, 2nd Floor, Huntington, NY 11743, USA, is the data controller for personal data processed in connection with the eGifter Services.

2. Overview

The revised FADP is closely aligned with the EU GDPR framework. Unless otherwise stated in this addendum, the provisions of the eGifter EU / EEA Privacy Addendum (GDPR) apply equally to Swiss residents, with the following differences and clarifications as required by the FADP.

3. Legal Bases for Processing

Under the FADP, we process personal data where:

  • Processing is necessary to perform a contract with you or take pre-contractual steps at your request
  • You have given your consent
  • Processing is necessary for our legitimate interests, provided these are not overridden by your fundamental rights
  • Processing is required by law

4. Your Rights Under the FADP

As a Swiss resident, you have the following rights:

  • Right of access: request information about whether and how we process your personal data
  • Right to rectification: request correction of inaccurate personal data
  • Right to erasure: request deletion of personal data in certain circumstances
  • Right to data portability: receive your personal data in a structured, commonly used, machine-readable format
  • Right to object: object to processing in certain circumstances

5. International Data Transfers

Your personal data may be transferred to and processed in jurisdictions outside Switzerland, including the United States and other countries where our service providers or merchant partners are located. Where required by applicable law, we implement appropriate safeguards to protect personal data in connection with such transfers, in accordance with the Swiss Federal Act on Data Protection and guidance from the Swiss Federal Data Protection and Information Commissioner (FDPIC).

6. Automated Decision-Making

Where we use automated processing that produces legal or similarly significant effects on you, you may have rights related to such processing, including the right to request information and applicable safeguards, as required by the FADP.

7. Security and Safeguards

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration, or disclosure, taking into account the nature, scope, context, and purposes of processing, the state of the art, the cost of implementation, and the risks to data subjects. These measures are reviewed and updated as appropriate. Further details on our security practices are described in the eGifter Global Privacy Policy.
